Don’t miss the study “Justice under surveillance: legal frameworks against corruption and for the protection of whistleblowers” conducted under the direction of Caroline Joly, partner at Baro Alto, in collaboration with the White Collar Crime and Criminal Law group at IR GLOBAL

This comparative study, which analyzes the various national legal mechanisms for combating corruption, had two objectives: to identify the existence of specialized authorities in this field and to analyze the legal status granted to whistleblowers.

The aim was to identify, at the international level :
1️⃣ Countries with the most effective and severe repressive policies against corruption,
2️⃣ As well as those offering the most protective status for whistleblowers, in particular the US model with its system of financial incentives accompanied by legal guarantees (via the SEC, the Dodd-Frank Act, and more recently the AMLIA).

Three areas of analysis were therefore prioritized :
✅ The existence or absence of independent authorities or courts specializing in the fight against corruption ;
✅ The severity of penalties imposed in recent years in emblematic cases ;
✅ The recognition (or lack thereof) of a protective legal framework for whistleblowers. 

The result ?
An analysis presented in the form of comparative maps illustrating the structural differences between the countries studied and providing a cross-cutting and pragmatic overview of the legal tools that can be used in the fight against corruption.
